Welcome to the Enboarder Customer Community! The community is made up of Enboarder customers, partners and employees and serves as a go-to destination for Enboarder product know-how, peer-to-peer support and thought leadership on best practices. We also ideate with customers directly on how to improve and extend the Enboarder platform. We’d love to see users learn from each other and build their influence and profile on the Enboarder Customer Community.

These Enboarder Customer Community Terms of Use (“Community TOU'') are the terms that apply to your use of the Community. We hope that these will help ensure the community is valuable to you and serves as a platform where we can all become better together. The Community TOU also protects the interests of all of our members, as well as our goodwill and reputation. By using the Enboarder Customer Community, you are agreeing to these Community TOU.

Every community user of ours agrees to abide by these Community TOU and is responsible for any violations. You are not allowed to assist or engage others in a way that would violate these Community TOU. We will enforce and ensure compliance with this Community TOU by using methods we consider to be appropriate.

We reserve the right to modify these Community TOU at any time without giving you prior notice. You can find the most recent version at the URL for this page or as otherwise made available by us. Your use of the community following any such modification constitutes your agreement to follow and be bound by these Community TOU as modified. You agree to review the Community TOU on a regular basis and always remain in compliance.

Definitions

“Agreement” or “Community TOU” means these Enboarder Customer Community Terms of Use and all materials referred or linked to in here.

“Community Content” means all content, including without limitation, language, data, information, and images, provided through or disclosed by use of the Community, whether by us, our customers, or other users of the Enboarder Customer Community. Community Content does not include Your Content.

“Community Guidelines” means the usage guidelines applicable to users of the Enboarder Customer Community.

“Enboarder Customer Community” means the online community accessible at community.enboarder.com

"Enboarder", "we", "us" or “our” means Enboard.Me Pty Ltd and our affiliates.

"You" or "your" means the person or entity using the Enboarder Customer Community.

"Your Content” means all content, including without limitation, language, data, information, and images, provided through or disclosed by use of the Enboarder Customer Community, by you.

Access to the Enboarder Customer Community

We will provide you access to use the Enboarder Customer Community according to the terms of this Agreement. In order to access and use the Enboarder Customer Community, you may be required to establish a username, and you grant us the right to share the information necessary to enable your use of the Enboarder Customer Community.

You may not use a username that: (i) belongs to someone else, (ii) impersonates another person, (iii) is misleading, (iv) violates any intellectual property or other proprietary rights, (v) is vulgar or offensive, (vi) uses ‘Enboarder’ as all or part of it, unless we provide express permission to do so, or (vii) we reject, which we may choose to do in our discretion. All information you provide in your profile must be accurate. If you believe your access to or use of the Enboarder Customer Community has been breached, compromised, or unauthorized, notify us immediately at community@enboarder.com.

Your Conduct and Content


Usage Guidelines. You must review and follow the Community Guidelines. We may change the Community Guidelines from time to time by updating the applicable website. Your use of the Enboarder Customer Community is subject to the Community Guidelines, which are incorporated to this Agreement by reference.

Acceptable Use. You will use the Enboarder Customer Community for its intended purpose only, and will not use it for solicitation or advertising purposes, unless we otherwise agree. Your Content should typically relate to inbound best practices, the Enboarder products or services or their use.

The Enboarder Customer Community is meant for public discussion, so you may not disclose or solicit anyone's private information or disclose confidential information. You are responsible for the use by third parties of any personal information disclosed by you to the Enboarder Customer Community, whether or not you permitted such use. This means that no private or personal information should be exchanged within the Enboarder Customer Community.

You are not permitted to sell, rent, lease, assign, sublicense, distribute, transmit, broadcast, commercially exploit, grant a security interest in, or otherwise transfer any right in the Enboarder Customer Community or Community Content. In addition, and without limiting the other requirements in this Community TOU, you may not (directly or indirectly) use the Enboarder Customer Community with content, or in a manner that:

  • is in violation of this Agreement;
  • is confidential, proprietary or discloses sensitive information;
  • discloses or solicits the private information of any person;
  • is threatening, abusive, harassing, stalking, or defamatory;

  • is deceptive, false, misleading or fraudulent;
  • is invasive of another's privacy or otherwise violates another’s legal rights (such as rights of privacy and publicity);
  • contains vulgar, obscene, indecent. libelous or unlawful material;
  • infringes a third party's intellectual property or other right(s);
  • publishes, posts, uploads, or otherwise distributes any software, music, videos, or other material protected by intellectual property laws (or by rights of privacy or publicity) unless you have all necessary rights and consents to do so;
  • uploads files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another person's computer;
  • downloads any file that you know, or reasonably should know, cannot be legally distributed in that way;
  • falsifies or deletes any author attributions, legal or proprietary designations, labels of the origin or source of software, or other material contained in a file that is uploaded;
  • restricts or inhibits any other user of the Enboarder Customer Community from using and enjoying our website and/or the Enboarder product;
  • harvests or otherwise collects information about others, including email addresses, without their consent;
  • damages, disables, overburdens, or impairs any Enboarder website, product or service or interferes with any other party's use and enjoyment of the Community;
  • consists of unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, commercial electronic messages, or any other form of solicitation;
  • mirrors or frames the Enboarder Customer Community website, or any part of it, on any other website or webpage;
  • attempts to gain unauthorized access to the Enboarder Customer Community, or access the Enboarder Customer Community by any means other than through the interface that we provide to you;
  • is legally actionable between private parties; and/or
  • is in violation of any applicable law, rule or regulation.

Our failure to enforce these restrictions or guidelines shall not act as a waiver for any future enforcement, will not be considered a breach of these Community TOU by Enboarder, and does not create a private right of action by any other party.

Suspension and Notice of Violations. We may immediately suspend your use of the Enboarder Customer Community, without notice, for actual or suspected violations of the terms contained in these Community TOU. If you know of usage that is in violation of this Agreement, please let us know by contacting us at community@enboarder.com, and following the process for claims of copyright infringement described below.

​​​​​​​​​​​​​​Claims of Copyright Infringement. We respect the intellectual property rights of others, and we ask our users to do the same. We may, in our sole discretion, suspend the access or terminate the accounts of users who violate others' intellectual property rights.

Our Use of Your Content. You grant to us and our service providers a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, non-exclusive, sublicensable, transferable license and permission to use, display, reproduce, modify, adapt, create derivative works from, publicly perform, publicly display, distribute, disseminate, make, have made and otherwise use Your Content in connection with the Enboarder Customer Community. We may edit or remove Your Content, or block or disable replies on a topic, at any time in our sole discretion. You also grant us the rights to re-use Your Content to market and promote, such as on our website, in public or private presentations, press releases and interviews, or in connection with our sales and marketing and other publicity efforts. We will endeavor to work with you before re-using Your Content.

Enboarder retains the right to remove content and limit users’ access.

Enboarder does not generally edit, monitor or pre-screen content posted by users on The Enboarder Customer Community. However, Enboarder retains the right, at its sole discretion, to limit any users' access to the Enboarder Customer Community and to remove material that, in Enboarder's sole judgment, does not comply with these Community TOU, or that is otherwise inappropriate, harmful, objectionable, or inaccurate. Moderators may take any action they deem necessary in their own judgment to support these Community TOU. Such actions may include editing or deleting material and temporary or permanent banning of individual users.

To report violations, please use the Report Inappropriate Content feature or contact the Enboarder Customer Community moderators at community@enboarder.com. Please include the message board name and a link to the relevant post.

Private messages and moderator actions.

Moderator actions and the contents of private exchanges with moderators, staff members and administrators should not be shared or discussed on the public forums. Such material will be removed by moderators. If you have questions or comments regarding moderator actions, contact the forum administrator, staff or moderators through private message or by sending an email to community@enboarder.com.

Disclaimer of Warranties and Limitation of Liability.

Users like you provide much of the material on the Enboarder Customer Community. Such third-party content is the sole responsibility of the person originating the material. Enboarder does not control and is not responsible for this third-party material.

All information provided on the Enboarder Customer Community is provided "as is" without warranty of any kind, either expressed or implied. Enboarder does not warrant or guarantee the accuracy, reliability, completeness, usefulness, non-infringement of intellectual property rights, or quality of any material in the community, regardless of the source of the material. Enboarder and its suppliers will not be liable or responsible in any way for any Community Content on the Enboarder Customer Community, including, but not limited to, any errors or omissions in the material, or for any losses or damage of any kind incurred as a result of the use of or reliance on any material.

Enboarder makes not warranty or representation that: (i) the Enboarder Customer Community will meet your requirements; or (ii) access to the Enboarder Customer Community will be uninterrupted, timely, secure, virus-free, or error-free.

Enboarder shall not be liable for any lost profits, loss of data or goodwill, or cost of cover, or for any indirect, incidental, special, exemplary, punitive, or consequential damages, including damages arising from any type or manner of commercial, business, or financial loss, even if Enboarder had actual or constructive knowledge of the possibility of such damages and regardless of whether such damages were foreseeable. In no event shall Enboarder total liability to you for any and all claims arising from or relating to this to your access to or use of (or inability to access or use) the Enboarder customer community or community content exceed fifty united states dollars ($50.00 USD).

The foregoing limitations, exclusions and disclaimers shall apply regardless of whether such liability arises from any claim based upon contract, warranty, tort (including negligence), strict liability or otherwise, and whether or not the party has been advised of the possibility of such loss or damage. Insofar as applicable law prohibits any limitation on liability herein, the parties agree that such limitation will be automatically modified, but only to the extent so as to make the limitation compliant with applicable law. The parties agree that the limitations on liabilities set forth herein are agreed allocations of risk and such limitations will apply notwithstanding the failure of essential purpose of any limited remedy.

Trademarks.

The trademarks, logos and service marks displayed within the Enboarder Customer Community are the property of Enboarder or other third parties. Users are not permitted to use these Marks without the prior written consent of Enboarder or such third party which may own the mark.

Cookies.

You do not need to have cookies turned on to view forum postings. However, with cookies turned off or if you do not accept the cookie from the forum, you will not be permitted to sign in to The Enboarder Customer Community to post content or respond to postings.

International Site Use.

All community content is in English.

Links to Third Party Sites

The Enboarder Customer Community may contain links to third party sites. Access to any other internet site linked to this website is at the user's own risk and Enboarder is not responsible for the accuracy or reliability of any information, data, opinions, advice or statements made on these sites. Enboarder provides these links merely as a convenience and the inclusion of such links does not imply an endorsement. Any links posted by you are subject to all terms and conditions like any other type of content posted to the Enboarder Customer Community. You may not post a link that directs users to any content or information that would constitute a violation of these Terms of Use.

Access to Password Protected/Secure Areas.

Access to and use of password protected and/or secure areas of the website is restricted to authorized users only. Unauthorized individuals attempting to access these areas of the website may be subject to prosecution.

Enboarder Employees

Enboarder employees are required to adhere to these Community TOU. Your participation here is subject to our Usage Guidelines and our Community TOU.
